Refund, Withdrawal and Digital Content Policy
1. About This Policy
This policy applies to purchases from Jaroslav Holub, trading as Develop Device / Develop Device Studio ("Develop Device", "we", "us" or "our") through developdevice.com.

Nothing in this policy limits any mandatory rights available to consumers under applicable law, including rights relating to faulty or non-conforming digital content or services.
2. What We Sell
Our store mainly supplies digital music-production products, including presets, profiles, impulse responses (IRs), samples, MIDI content, DAW templates, bundles, software/plugins and related digital materials. We also offer custom services, such as personalized presets, profiles, templates and other bespoke audio-production work.
Digital products are supplied electronically, normally through a download link, email and/or your customer account after successful payment. No physical goods are shipped for these products. For delivery details, see our Delivery Policy.
3. Digital Products and Change-of-Mind Refunds
Because downloadable digital products cannot practically be returned after access is provided, we do not offer voluntary change-of-mind refunds for digital products once the content has been made available, accessed or downloaded, except where applicable law requires otherwise or we expressly agree to an exception.
This includes purchases made in a sale or promotion and purchases of bundles after access to any included digital product has been provided. Discounted purchases are still covered by all mandatory consumer rights.
4. EEA and Other Statutory Withdrawal Rights
If you are a consumer in the European Economic Area (EEA), you generally have a statutory right to withdraw from an online contract within 14 days without giving a reason, unless a legal exception applies.
For digital content not supplied on a tangible medium (such as downloadable presets, profiles, samples, templates or software), your statutory withdrawal right is lost only where the supply has begun during the withdrawal period after you have:
- given your prior express consent to immediate supply before the withdrawal period expires; and
- acknowledged that by doing so you lose your right of withdrawal once supply begins, with the required confirmation being provided to you.
How we obtain and confirm your consent: For digital products that can be accessed or downloaded immediately, we ask you, before you complete checkout, to expressly request immediate supply and to confirm that you understand and accept that you will lose your 14-day right of withdrawal once delivery of that digital content begins. We record this request and acknowledgement together with your order and confirm it to you in your order confirmation email, which serves as confirmation on a durable medium.
Where those requirements are satisfied and digital delivery/access has begun, no withdrawal refund is due for that digital content. If those requirements are not satisfied, your statutory rights remain unaffected.
Consumers in other jurisdictions, including the United Kingdom, may have similar cancellation or withdrawal rights under their local laws. We will honor all mandatory rights that apply to your purchase.
5. Custom and Bespoke Services
Custom preset creation, bespoke templates, personalized profiles and other commissioned production work involve services and/or personalized digital deliverables. The scope, estimated timeline and included revisions may also be set out in the product description or individual agreement.
Our service commitment: You may cancel a custom or bespoke service for a full refund at any time before we begin work on your project. After your custom service has been delivered, we include revisions until you are satisfied with the result, at no additional cost. These commitments are offered in addition to, and do not limit, your mandatory statutory rights.
For EEA consumers purchasing a service, if you expressly request that work begin during the withdrawal period and then withdraw before the service is completed, you may be required to pay a proportionate amount for work already performed, where permitted by law. The statutory withdrawal right for a service is lost after the service has been fully performed only where the applicable requirements for your prior express consent and acknowledgement have been met.
Once a personalized digital deliverable has been supplied, the rules applicable to digital content may also apply. Nothing in this section removes your mandatory rights if a service or deliverable is not supplied with reasonable care, is not as agreed, or is otherwise non-conforming.
6. Problems With a Product or Payment
Please contact us if:
- you received the wrong digital product;
- a file is corrupted, incomplete or cannot be accessed because of a problem on our side;
- a product materially differs from its description or does not meet stated compatibility requirements;
- a custom service or deliverable is not as agreed;
- you were charged more than once for the same intended purchase; or
- you believe a refund, cancellation or other remedy is required by applicable law.
Where a digital product or service is defective or non-conforming, we may first seek to remedy the problem by providing the correct file, restoring access, correcting the content or completing the agreed service. Depending on the circumstances and applicable law, you may be entitled to a price reduction, contract termination and/or refund.
7. Compatibility and Purchasing the Correct Product
Many products require specific third-party hardware or software, for example a particular amp modeler, drum library, plugin or DAW. Please check the product description, required software/hardware, versions and file formats before purchasing, and contact us before purchase if you are uncertain.
A change-of-mind request after valid delivery is not ordinarily refundable merely because you purchased a format for equipment you do not own or prefer a different sound. However, this does not affect your rights where our listing was inaccurate, misleading, or the product fails to meet stated requirements.
8. Bundles and All-Access Offers
Bundles and all-access offers contain multiple digital products. Once access or download has begun for any included content after any required consent and acknowledgement, we do not provide voluntary refunds for the bundle because of a change of mind. This does not affect remedies for faulty, missing or misdescribed content or any other mandatory statutory rights.
9. How to Request a Refund, Withdrawal or Remedy
Contact us at support@developdevice.com and include:
- your order number and the email address used for your order;
- the product or service concerned;
- whether you are requesting withdrawal/cancellation or reporting a problem; and
- relevant details or screenshots where they help us identify a technical issue.
If you are exercising a statutory withdrawal right, an unequivocal statement by email is sufficient. For example: "I hereby withdraw from my contract for [product/service], ordered on [date], order number [number]." Please send it before the applicable withdrawal period expires.
We aim to respond within 2-3 business days. If a refund is approved or legally required, it will be issued to the original payment method without undue delay. The time taken for funds to appear may depend on your payment provider.
