This Privacy Policy explains how Jaroslav Holub, trading as Develop Device / Develop Device Studio ("Develop Device", "we", "us" or "our") collects, uses and shares personal information when you visit developdevice.com, use an account at account.developdevice.com, purchase digital products or services, contact us, or otherwise interact with our online store (together, the "Services").

2. Scope
Our store offers digital music-production products, including presets, profiles, impulse responses, templates, samples, MIDI content and software/plugins, as well as custom audio-production services. There is no physical shipping for digital products. This Policy applies to personal information handled in connection with these activities. Third-party websites and services linked from our store are governed by their own privacy policies.
3. Personal Information We Collect
Depending on how you interact with us, we may collect the following categories of personal information:
- Contact and account information: name, email address, account credentials or account authentication details, telephone number and billing address where provided.
- Order and transaction information: products or services purchased, order number, prices, currency, tax/VAT information, payment status, billing details and refund history. Payment card or wallet credentials are handled by the selected payment provider; we do not receive your complete card number.
- Digital delivery and service information: download entitlements and download/access activity, license or access information, and, for custom services, project instructions, communications and audio or other files that you submit.
- Support and communications: emails, contact-form submissions, live chat or messaging interactions, reviews or other information you choose to send us.
- Marketing information: email subscription status, consent and preference records, and your interaction with marketing communications.
- Device and usage information: IP address, browser and device details, cookie and similar identifier data, referring URLs, pages viewed, searches, product interactions, cart and checkout activity, purchase events and diagnostic/security data.
- Information from connected services: if you use Shop or Google sign-in for your customer account, we receive information needed to authenticate and maintain your account in accordance with your choice and that provider's policies.
4. How We Collect Information
We collect information directly from you when you create an account, buy a product, subscribe, contact us or provide project materials; automatically through our Shopify storefront, cookies, pixels and similar technologies; and from providers that support checkout, account sign-in, payments, digital delivery, analytics and advertising.
5. Purposes and Legal Bases
Where the GDPR or UK GDPR applies, we process personal data on the following legal bases:
- Performance of a contract: to process orders and payments, provide accounts, deliver downloads or software access, complete custom services, communicate about an order and provide requested support.
- Legal obligations: to keep accounting and tax records, issue invoices, respond to lawful requests and meet consumer-protection or other legal requirements.
- Legitimate interests: to secure the store, prevent fraud and misuse, maintain and improve the Services, diagnose problems, administer our business and respond to non-contractual enquiries, provided those interests are not overridden by your rights.
- Consent: to send email marketing where consent is required and to use non-essential analytics or advertising technologies where required by applicable law. You may withdraw consent at any time without affecting earlier processing.
We use personal information to operate the store, provide purchased digital products and services, administer customer accounts, send transactional communications, provide support, offer a newsletter and promotions, understand and improve site performance, measure advertising, display or measure relevant advertising where permitted, protect against fraud and comply with law.
6. Cookies, Analytics and Advertising
Our Services use cookies and similar technologies needed for Shopify storefront functionality, checkout, customer accounts, security, fraud prevention, language/currency preferences and digital delivery. Subject to your consent where required, we also use technologies for analytics and marketing measurement.
Current integrations on our storefront include:
- Shopify analytics and customer privacy tools for storefront operation, measurement and management of privacy choices.
- Google services, including Google Analytics and Google advertising / Google & YouTube channel functionality, to measure site and purchase events and support product advertising or listings.
- Meta (Facebook and Instagram) marketing technology, including Meta pixel-related functionality, to measure advertising performance and support targeted advertising where permitted.
- Microsoft Clarity to understand website use and improve user experience through behavioral analytics.
Depending on your jurisdiction, marketing or analytics cookies and pixels are used only after the required consent or may be subject to an opt-out right. You can use any cookie preferences control made available on the store, adjust browser settings, or use our Your Privacy Choices page. Where applicable, we honor Global Privacy Control signals for browser-based activity that may constitute sale, sharing or targeted advertising under U.S. state privacy laws.
7. Service Providers and Recipients
We may disclose personal information to providers only as necessary for the purposes described above, including:
- Shopify, which hosts and operates our online store, checkout, customer accounts, Shop-related features and customer privacy tools.
- Fileflare, used to provide digital-product downloads and access after purchase.
- Payment and wallet providers selected at checkout, which may include Shopify Payments and payment networks, PayPal, Klarna, Apple Pay, Google Pay, Shop Pay, Bancontact or iDEAL, depending on your location and selected payment method.
- Google for account sign-in where selected by you, analytics, advertising measurement and product/channel integrations.
- Meta for Facebook and Instagram marketing, advertising measurement and targeted advertising functionality where enabled and permitted.
- Microsoft Clarity for site usage analytics and experience improvement.
- Communication and support tools used to respond to requests, provide store messaging and send order or marketing communications.
- hCaptcha, used on our privacy opt-out form to protect against abuse.
- Professional advisers, authorities or other parties where necessary to comply with law, establish or defend legal claims, prevent fraud, or protect rights and safety.
Each third-party provider may process information under its own privacy terms where it acts as an independent controller, particularly payment, wallet, social sign-in and advertising providers.
8. International Transfers
We are established in the Czech Republic. Some providers, including Shopify, Google, Meta and Microsoft, may process personal information outside the Czech Republic or European Economic Area. Where required, transfers are made subject to appropriate transfer mechanisms and safeguards, such as adequacy decisions or standard contractual clauses, together with supplementary measures where appropriate. 9. Retention
We keep personal information only for as long as reasonably necessary for the purposes in this Policy, including:
- order, invoice, payment and tax records for periods required by applicable accounting and tax law;
- account and digital-download access information while your account or continuing product access remains active, and as needed to establish purchase and license rights;
- custom service materials and communications for the time needed to perform the service, provide support and address claims or legal requirements;
- marketing subscription data until you unsubscribe or withdraw consent, while retaining necessary suppression records; and
- analytics, cookie and advertising information according to the retention settings and legal requirements applicable to the relevant tools.
10. Your Rights
If the GDPR or UK GDPR applies, you may have the right to request access to, correction of, deletion of or restriction of your personal data; object to processing based on legitimate interests or to direct marketing; request portability of data you provided; and withdraw consent at any time where processing is consent-based. You also have the right to lodge a complaint with a supervisory authority. In the Czech Republic, the supervisory authority is the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), uoou.gov.cz.
Residents of certain U.S. states may have rights to know/access, correct, delete or obtain a copy of certain personal information, and to opt out of sale, sharing or targeted advertising as those terms are defined by applicable state law. We do not sell personal information for money. Certain advertising disclosures may nevertheless be considered a "sale" or "sharing" under those laws. To exercise a privacy right, email support@developdevice.com. We may need to verify your identity before completing a request. We will not discriminate against you for exercising applicable privacy rights.
11. Marketing Communications
If you subscribe to our newsletter or choose marketing communications, we may email you product news, offers and music-production content. You may unsubscribe at any time using the link in a marketing email or by contacting us. Transactional messages about purchases, downloads, accounts or requested support are not marketing communications.
12. Security
We use reasonable technical and organizational measures intended to protect personal information. No transmission or storage system is completely secure, and we cannot guarantee absolute security.
13. Children
Our Services are not directed to children under 18 and we do not knowingly collect personal information from children. If you believe a child has provided personal information to us, please contact us so that we can take appropriate action.
14. Changes to This Policy
We may update this Privacy Policy to reflect changes to our Services, providers or legal obligations. We will post the updated version on this page and revise the effective date above. Where required by law, we will provide additional notice or seek consent.
